Terms and Conditions of Sale

1. Purpose

These General Terms and Conditions of Sale (hereinafter, 'T&Cs') define the rights and obligations of Book.fr – 101 avenue mauriat – 13100 Aix-en-Provence – France – SIREN 812245132 (hereinafter, 'the Seller') and any natural or legal person purchasing products and/or services offered on the Seller's website (hereinafter, 'the Customer').

2. Products, Services, and Prices

The Seller offers physical goods, services, and digital content related to artistic creation. Each offer specifies its essential features and price in Euro, excluding taxes and shipping fees. Applicable taxes and shipping fees are calculated at checkout after the Customer's address is entered.

3. Order and Payment

Payment is made in full and securely by credit card via the Stripe payment service provider. The order is considered final once payment has been confirmed. A summary of the order and a payment receipt are sent to the Customer by email to the address provided at the time of the order.

Any request for modification or cancellation must be sent promptly to the Seller, who may accept or decline it depending on the order's preparation status.

The Seller reserves the right to refuse or cancel any order in the event of a previous payment dispute or suspected fraud.

4. Delivery

In-stock products are dispatched within 30 days maximum of order confirmation. Delivery times may vary depending on the destination.

The Seller cannot be held responsible for delivery delays or failures due to the carrier, or for consequences arising from incomplete or incorrect address information provided by the Customer. In case of a damaged package (opened, missing products, etc.), the Customer must inform both the carrier and the Seller as soon as possible.

For digital content, access is provided immediately after purchase to the email address provided by the Customer. It is recommended to also check the 'junk mail' or 'promotions' folder. If not received, the Customer can contact customer service.

5. Warranties and Liability

The Seller is responsible for the conformity of goods and services sold, within the limits of applicable law. The Seller's liability is strictly limited to the value of the relevant order. The Seller cannot be held liable for any indirect or non-material damage resulting from the use of the products or services sold.

6. Right of Withdrawal

General Conditions

The Customer has a period of 14 days from the date of delivery or conclusion of the service contract to exercise their right of withdrawal without having to provide a reason. The withdrawal decision must be notified to customer service before the deadline expires. Items must be returned in their original condition; return shipping costs are the responsibility of the Customer. A refund will be issued within 14 days of receiving the returned item(s).

Exceptions

  • Goods made to the Customer's specifications or clearly personalized (commissioned artworks, non-catalog prints, specific sizes or finishes)
  • Digital content and services provided immediately after the order
  • Services fully performed before the end of the 14-day period
  • Services related to an event scheduled for a specific date or period
  • Sealed audio, video, or software recordings that have been unsealed after delivery

7. Personal Data

The data collected (identity, delivery address) is necessary to process orders. It is not shared with third parties for commercial purposes. It is retained for ten years to meet accounting and tax obligations, after which it is deleted or anonymized.

Stripe acts as a secure payment intermediary. Payment data, including in particular bank card details, are processed directly by Stripe; they are neither processed nor stored by the Seller. The Seller only provides Stripe with the Customer's email address and the information relating to their order (shopping cart).

In accordance with the General Data Protection Regulation (GDPR), the Customer has the right to access, rectify, delete, or object to the processing of their data. For any request, please contact customer service.

8. Applicable Law and Dispute Resolution

In the event of a dispute, the Customer is encouraged to seek an amicable solution by contacting customer service. The Customer may also access a consumer mediation service free of charge, in accordance with the provisions of the Consumer Code. Mediation is optional but recommended before taking legal action.

Artfolio - Book.fr acts as a host for the content and offers published by the Seller and as a simple technical intermediary. It is not a party to the sales contract concluded between the Customer and the Seller; any claim or dispute related to the order must be addressed directly to the Seller.

These T&Cs are governed by the laws in force at the Seller's place of establishment. Failing an amicable agreement, disputes shall fall under the jurisdiction of the courts at the Seller's place of establishment.
